Legal Waiver and Release Agreement

1. Definitions and Scope
1.1. Kiibzz: Refers to the registered company, Kiibzz (Enterprise Number: 2025/254062/07), operating in South Africa under the AfriTele brand.
1.2. Platform: Denotes the AfriTele website (www.afritele.com) and all associated services, including courses, certifications, and the affiliate program.
1.3. User: Any individual or entity accessing or utilizing the Platform or participating in any of its services or programs.
1.4. Waiver: This Legal Waiver and Release Agreement, in conjunction with our Terms and Conditions, Disclaimer, and User Agreement, governs the relationship between the User and Kiibzz.
2. Acknowledgment of Risk
2.1. The User acknowledges that participation in any activity on the Platform—including but not limited to course participation, exam taking, affiliate marketing, or use of any digital content—carries inherent risks.
2.2. These risks include, without limitation, technical failures, data loss, inaccuracies in content, and any potential physical, financial, or reputational harm.
2.3. By proceeding, the User confirms that they have been informed of these risks and voluntarily assume full responsibility for any outcomes that may result from their participation.
3. Waiver and Release of Liability
3.1. General Waiver: In consideration for being permitted access to and use of the Platform, the User hereby waives, releases, and discharges Kiibzz, its affiliates, officers, directors, employees, agents, and representatives from any and all claims, liabilities, damages, costs, and expenses of any nature arising directly or indirectly from the User’s participation or use of the Platform.
3.2. Scope of Release: This release extends to any claims based on breach of contract, negligence, strict liability, or any other legal theory, even if Kiibzz has been advised of the possibility of such damages.
3.3. Irrevocability: This waiver is binding, irrevocable, and enforceable against the User and their successors, assigns, heirs, and legal representatives.
4. Indemnification
4.1. The User agrees to indemnify, defend, and hold harmless Kiibzz and its affiliates from and against any and all claims, actions, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with the User’s participation on the Platform or breach of this Waiver.
5. Assumption of Risk
5.1. The User explicitly acknowledges that they understand the risks involved with the use of the Platform and that any errors, omissions, or interruptions in service are not grounds for liability on the part of Kiibzz.
5.2. The User agrees that any reliance on information or content provided on the Platform is solely at their own risk.
6. Binding Arbitration and Dispute Resolution
6.1. The User agrees that any disputes arising under or in connection with this Waiver or their use of the Platform shall be resolved exclusively through binding arbitration administered by Kiibzz, in accordance with the applicable rules.
6.2. The User further waives any right to a trial by jury or to participate in a class action or collective litigation.
7. Governing Law and Severability
7.1. This Waiver shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.
7.2. If any provision of this Waiver is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8. Acknowledgment and Acceptance
8.1. By accessing or using the Platform, the User acknowledges that they have read, understood, and agree to be bound by this Legal Waiver and Release Agreement, in addition to all other related agreements provided by Kiibzz.
8.2. The User further acknowledges that they are voluntarily entering into this agreement, fully aware of its legal consequences, and that no inducements, promises, or representations have been made to alter the terms of this Waiver.
