User Agreement

1.1. Binding Contract: This User Agreement (“Agreement”) is a legally binding contract between you (“User”) and Kiibzz (Enterprise Number: 2025/254062/07), operating under the AfriTele brand in South Africa. By accessing or using the Platform (www.afritele.com) or any related services, you acknowledge that you have read, understood, and agree to be bound by this Agreement and all incorporated documents, including the Terms and Conditions, Disclaimer, and Legal Waiver.
1.2. Purpose: This Agreement sets forth the rights, responsibilities, and limitations for Users accessing and utilizing the Platform’s online educational content, courses, examinations, affiliate program, and any other services provided by Kiibzz.
2.1. User: Any individual or entity accessing, purchasing, or using the Platform.
2.2. Platform: The AfriTele website and all associated online services, including courses, certification exams, digital content, and affiliate functionalities.
2.3. Content: Any materials, information, or data provided on the Platform, including those generated or assisted by artificial intelligence.
2.4. Affiliate: Any individual or entity participating in the Kiibzz affiliate program as outlined in the Terms and Conditions.
3.1. Consent: By using the Platform, you expressly consent to the terms of this Agreement, as well as the Terms and Conditions, Disclaimer, and Legal Waiver. If you do not agree with any part of this Agreement, you must not access or use the Platform.
3.2. Amendments: Kiibzz reserves the right to modify this Agreement at any time without prior notice. Your continued use of the Platform constitutes acceptance of the revised terms.
4.1. Accurate Information: You agree to provide accurate, current, and complete information as required for registration and use of the Platform.
4.2. Compliance: You shall comply with all applicable laws, regulations, and policies when using the Platform.
4.3. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5.1. Authorized Use: You agree to use the Platform solely for lawful purposes and in a manner that does not infringe the rights of or restrict the use and enjoyment of the Platform by any third party.
5.2. Prohibited Conduct: The User is strictly prohibited from engaging in any activity that may damage, disable, or impair the Platform or its related services. This includes, but is not limited to, unauthorized access, distribution of malicious software, or any other conduct deemed harmful by Kiibzz.
6.1. Disclaimer of Warranties: The Platform is provided on an “as is” and “as available” basis without any warranties, either express or implied. Kiibzz disclaims any warranty of uninterrupted access, error-free operation, or the accuracy of content.
6.2. Liability Cap: In no event shall Kiibzz or its affiliates be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Platform, even if advised of the possibility of such damages. 6.3. User Acknowledgment: You acknowledge and agree that any reliance on the Platform’s content is at your own risk and that Kiibzz shall not be responsible for any losses or damages incurred as a result.
7.1. User Indemnity: You agree to indemnify, defend, and hold Kiibzz, its affiliates, officers, directors, employees, and agents harmless from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Platform or any violation of this Agreement.
8.1. Binding Arbitration: Any disputes, claims, or controversies arising out of or relating to this Agreement or your use of the Platform shall be resolved exclusively through binding arbitration administered by Kiibzz, in accordance with the applicable rules.
8.2. Waiver of Litigation: You hereby waive any right to a trial by jury, to participate in a class action, or to bring any claim in a court of law regarding any matters covered by this Agreement.
9.1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.
9.2. Severability: If any provision of this Agreement is found to be invalid or unenforceable under any applicable law, the remaining provisions shall remain in full force and effect.
10.1. Comprehensive Contract: This Agreement, together with the Terms and Conditions, Disclaimer, and Legal Waiver, constitutes the entire agreement between you and Kiibzz regarding your use of the Platform and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
11.1. User Confirmation: By accessing or using the Platform, you confirm that you have read, understood, and voluntarily agree to be bound by this User Agreement and all related documents.
11.2. Legal Binding: You further acknowledge that this Agreement is intended to protect Kiibzz to the fullest extent permitted by law, and that any claims or actions against Kiibzz shall be subject to the limitations and resolutions described herein.
